1. Who we are and scope
This website and online store (together, the "Services") are operated by Folk Mode, a trading name of Lodecom ("Folk Mode", "we", "us", "our"). By visiting our website or placing an order you accept these Terms of Service (the "Terms") and the documents they refer to, including our Privacy Policy, Shipping Policy and Returns and Refunds Policy.
Our store is hosted by Shopify Inc., whose ecommerce platform allows us to offer our products and Services to you.
Nothing in these Terms affects your statutory rights as a consumer.
2. Using our Services
To use the Services you must be of legal age in your country or region of residence, or have the permission of a parent or guardian. You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
You may not upload or transmit viruses, malware or any other harmful code.
We reserve the right to refuse service, suspend accounts or cancel orders at our discretion where we believe these Terms or applicable law are being breached.
3. Changes to the site and to these Terms
Content, features and prices on our website may be updated at any time without notice. We may also amend these Terms from time to time by publishing an updated version on this page. If you continue to use the Services after changes are published, you accept the updated Terms. The Terms that apply to your order are those in force at the time you place it.
4. Products, prices and availability
Product descriptions, images, colours, prices and available quantities may change at any time. We aim to present every product as accurately as possible, but we cannot guarantee that the colours shown on your screen match the physical product exactly.
We are a retailer. We select our range from our suppliers and we do not manufacture the items ourselves.
All prices are shown in GBP and include applicable taxes. Shipping is £0.00 on all orders. Where a product is shown with a reference price alongside the selling price, the reference price is the price at which we previously offered that item.
We may limit the sale of products to certain people, regions or jurisdictions, and may limit quantities per order, account or address.
5. Orders and acceptance
When you place an order you are making an offer to buy. A contract is formed when we send you an order confirmation by email. We may accept, refuse or cancel an order, for example in cases of suspected fraud, availability problems or pricing errors. If we need to change or cancel your order we will try to contact you using the email address or phone number you provided at checkout, and we will refund you in full where payment has been taken.
6. Billing and account details
You agree to provide accurate, current and complete purchase and account information, and to keep details such as your email address, delivery address and payment details up to date. We may refuse or cancel orders placed with incorrect or unverifiable details.
7. Shipping, delivery and returns
Everything relating to shipping, delivery times and returns is described in our Shipping Policy and Returns and Refunds Policy, which you will find in the footer of our website. Please read both carefully before ordering.
We deliver to addresses in the United Kingdom. Orders are processed within 1 to 3 working days and delivered within 5 to 12 working days, which is 6 to 15 working days in total in most cases. Delivery is handled by Royal Mail. Delivery times are estimates.
The return period, conditions, costs and return address are set out in the Returns and Refunds Policy.
8. Your right to cancel
As a consumer you may cancel within 14 days of receiving the goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and we voluntarily extend this to 30 days from delivery. Return postage is paid by the customer, except where an item is faulty, damaged or incorrect. Full details are set out in our Returns and Refunds Policy.
9. Faulty goods and your statutory rights
Under the Consumer Rights Act 2015 goods must be as described, fit for purpose and of satisfactory quality. If goods are faulty you have a short term right to reject them within 30 days of delivery, and further rights to repair, replacement, a price reduction or a final right to reject after that period. These rights are in addition to our voluntary 30 day return period.
10. Third party tools and services
Our website may give you access to tools or services provided by third parties, such as payment providers, analytics tools or review widgets. These are offered "as is" and "as available" without any warranty from us. Use of third party tools, or visiting third party websites linked from our store, is at your own risk and subject to those third parties' terms. We are not responsible for their content, security or practices.
11. Reviews, feedback and other contributions
If you send us reviews, comments, ideas or other material ("Contributions"), you grant us a transferable, sublicensable and royalty free licence to use, reproduce, publish, translate and distribute those Contributions in order to operate and improve the Services. We may monitor, edit or remove content we consider unlawful, offensive, infringing or otherwise inappropriate.
You confirm that your Contributions do not infringe the rights of third parties, are not unlawful or defamatory, and contain no harmful code.
12. Personal data
All personal data you share with us is processed in accordance with our Privacy Policy, linked in the footer. It explains what we collect, how we use it and what rights you have under applicable data protection law.
13. Errors and omissions
Occasionally information on our website may contain typographical errors, inaccuracies or omissions, for example in product descriptions, pricing or availability. To the extent permitted by law we reserve the right to correct such errors and to update or cancel affected orders at any time. Where we cancel an order for this reason we refund you in full.
14. Prohibited uses
In addition to the other restrictions in these Terms, you may not use the Services or the content of our website:
- for any unlawful purpose;
- to breach any regulation, law or local ordinance;
- to infringe intellectual property rights;
- to harass, defame, discriminate against or harm others;
- to submit false or misleading information;
- to upload or distribute harmful code;
- to scrape, index or collect personal data of others without consent;
- to interfere with the security or proper functioning of the Services.
We may terminate or restrict your access if you breach these rules.
15. Disclaimer of warranties
Except where prohibited by law, the Services and all products are provided "as is" and "as available" without any express or implied warranty, including warranties of merchantability, fitness for a particular purpose, durability, title or non infringement. We do not warrant that the Services will be uninterrupted, timely, secure or error free. This does not affect the statutory rights you have under the Consumer Rights Act 2015, which remain fully applicable.
16. Limitation of liability
To the maximum extent permitted by law, Folk Mode and its directors, employees, affiliates, agents, suppliers and service providers are not liable for indirect, incidental, special or consequential loss, nor for loss of profits, revenue, savings, data or replacement costs arising from use of the Services or the products. We are liable for foreseeable loss caused by our failure to meet these Terms.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights, or for any other liability that cannot be excluded or limited by law.
17. Indemnity
You agree to indemnify and hold harmless Folk Mode and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable legal costs, arising from your breach of these Terms or your breach of any law or the rights of a third party. This does not apply to anything you do as a consumer acting outside a business.
18. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will still be applied to the fullest extent permitted by law, and the remainder of the Terms will continue to apply in full.
19. Termination
These Terms apply until terminated by you or by us. You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, without prejudice to any amounts owed up to the date of termination. Provisions which by their nature should survive termination will remain in force.
20. Entire agreement and waiver
These Terms, together with the policies published on our website, form the entire agreement between you and us in relation to the Services and replace all previous agreements and communications. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
21. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them (including non contractual disputes), are governed by Dutch law. If you are a consumer resident in the United Kingdom, you keep the protection of the mandatory consumer law rules of the United Kingdom, and you may bring proceedings in the courts of the United Kingdom.
22. Complaints and dispute resolution
If you have a complaint, email info@folkmode.com. We respond within 24 working hours and will work with you towards a solution. If we cannot resolve your complaint to your satisfaction, you may take the matter to the courts of the United Kingdom. Please note that the European Commission's online dispute resolution platform is no longer available to consumers resident in the United Kingdom.
